Their role must remain strictly supervisory or consultative. The Immigration Department emphasizes that visitor status does not confer the right to establish, join, or actively run a business.

For entrepreneurs who wish to set up or operate a company in Hong Kong, a separate visa type called “Investment as Entrepreneurs” must be obtained. This visa allows long-term residence and the right to manage local operations. Applicants for this type of visa must provide business plans, proof of capital, and evidence that their company will contribute to the Hong Kong economy through job creation or innovation.

Failure to comply with these conditions may result in a fine of up to HKD 50,000 and imprisonment for up to two years, according to Section 41 of the Immigration Ordinance (Cap. 115) of Hong Kong. Therefore, Nepali businesspeople should strictly adhere to permissible activities during their visit.
